Why not send me your licensing problems and i'll find the answers for you.

some topics will take alot of research so please bare with me.

 

if i get a good response i'll publish some in the magazine each month and i'll try in the future to give a prize to any published

is it breaking any licensing regs to take text bookings,

theres firms now where you text taxi to lets say 123456

and you get a text back saying how long it will be and you'll get a text when its outside, how can it be monitored and how do you know if it was taken outside the licensing area ?

what about internet bookings.


theres no phone call just at most an email, is this legislated for as all i can find mentioned anywhere is where the call was taken.
would an email be looked upon by lo as another form of phone call ?

3 Questions for you Tony.

1) Can an operator who uses ONLY hackneys charge a booking fee for telephone bookings? Say if someone booked a taxi over the phone (instead of hailing the cab on the street) for a journey that would clock £3.40 on the meter - can one charge say a minimum £4.00 for the telephone booking? (I think the cabs in London have a telephone booking fee)

2) Can the same hackney operator pass on bookings to a hackney driver who is licensed by a separate council?

3) Can this driver have the operators insignia on his vehicle? (so the operator is licensed by council A the driver/vehicle licensed by council B)

The answer to Question 2 is YES
The answer to Question 3 is YES

You can pass work to any other HACK but not PH cars.
To supply any PH car with work you need an operators license.

The answer to question 1 is a Grey area "maybe Tony can answer it better" but I know you can not exceed the current rate of fare that your licensing council allows you.
Hence your meter should be used as a hack each and every time a passenger gets into your vehicle.

Hi Steve,
Have to agree with you, a Hackney can only charge what is authorised by his L/A. We in Brighton & Hove did have a radio job booking fee agreed, it was never used by the taxi companies and was eventually discarded.

I rember calling a cab company in London (hackney carriage operator) and was told there was a telephone booking charge paybale - cant rember how much it was.

I have had my hackney carriage license revoked, and I have appealed against their decision. I was wondering if I could get any help with this matter from yourselves or any other party. Reasons for their decision are as follows.
(1) 15 points on driving license, when infact there are 9, 6 have already been spent and are now dead.
(2) An incident in Abingdon, was subsequently issued a MSS100. There was no charges what so ever.
(3) A caution for harassment, which was a domestic incident with my ex-wife. There was no violence involed and the incident was nearly over 2 years ago.

All of the above are not included in the licensing policy, which was indicated by the Citizen Advice Bureau.
Can someone help me ??
My appeal was adjorned today untill 15th May 2008.

Hello Tony

I need a quick answer to this question because i only have a day or two before the crunch.

The new Airport Taxi management company at Glasgow airport plan to install Radio's in all 177 cabs on Monday, but the actual Base will be in another area.

Is this Legal? Or is it true that the base must reside in the area in which it is to operate?

If this is referring to private hire........... than the private hire Office must be licensed in the district that it intends to operate within........... the private hire drivers must be licensed by the same authority.......... and also the vehicles must be licensed by the same authority...

Thanks for the quick response.

I apologise if i did not make myself clear. We are Hackney cabs licensed by Renfrewshire Council and the new radio system is to be based in Inverclyde which is another local authority in scotland.

We are being told that anyone who does not let them fit the radio's will be thrown off the rank.

recently had the licencing committee refuse a badge to a driver who has held a hackney badge previously , there reasons being that the applicant received a caution for a public order offense 2 years previous , does this not come under the discriminations act

To correct my misinformed colleague. The 20p booking fee is still a current charge on the tariff card, it may not be for much longer though as the compaines have denied the drivers this charge for so long the council have plans to remove it from the next 'increase' as it gives an 'inflated' view of the charges allowed.

Hi i am a taxi driver propietor in southend the council/hackney carriage are giving the amount of Taxi plates they want out for fun yearly saying its managed growth, this has flooded the market
the council used to conduct surveys now they say they have no funds, i am part of a union in southend please help.

Hi, have come across your great site whilst browsing the internet for help. I am a HC driver in Cheltenham and represent drivers from the rail station on our association and would be grateful for any help you could provide.

We have a HUGE problem with our council telling PHV drivers that if someone approaches them on the street and they call the job in over the radio before commencing the journey, this is a legal practice.

We believe that not only is this "touting", but the journey would not be insured as this is a public hire pick up.

The council quote a court test case (I am still trying to get the details) which my chairman says is Notts City Coucil V Amin, but I am sure it should be Notts V Woodings (1994), where a successful prosecution was obtained for exactly this type of activity  (JTH Button says prosecution should not have taken place)

I have trawled throught the Town Police Act 1847. LGMPA 1976, and local byelaws (which the handbook still states this must not happen!!), but we seem to be banging our heads against a brick wall.

Basically I am trying to get a definitive answer to 2 questions:

If a PHV driver is parked up and a member of the public approaches him/her and asks if they are available, are they allowed to call a booking in to their base and take the job  ??

Is this activity insured under PHV insurance ??

Our council like to quote our old friend James TH Button, but getting definite answers from them is like finding rocking horse whatsit !!
