Whilst picking up at the taxi office in the early hours of this morning a fight broke out between 2 lads trying to get into my taxi , one of the lads punched the other and then the other lad tried to punch the lad back but he missed and he put his fist through my back window.  I got out and kept hold of the lad who broke my window until the Police arrived , they arrested him for criminal damages and I had to go into the Police station later this morning and produce a statement.  I was disgusted to hear that if the lad pleads guilty he will only have to pay his £80 fine to the Police and he wont have to pay me the damage costs for my new window.  Has anyone experienced anything like this before and what would you recommend me to do.

NOTHING UNUSUAL THEN!!you will find that the police have little intention of assisting,had you been a member we would have put you in touch with a solicitor at no cost to yourself.my only advice is to contact the citizens advice,or speak to a solicitor obviously at a cost ,but you may be able to claim against home or house insurances of the accused if he pleads guilty.WHO SAYS HE WILL BE FINED£80.00 ?

The police said he will be fined £80 and this fee goes to them. Ive been trying to find out the lads name today but Im finding it hard , if I find where he lives he'll be getting a visit from me and he'll have an ultimatum either pay me my costs or ill pass his debt on to a few heavies in my area. The Police a re a complete waste of time.

This is a common scenario of todays time.
Unfortunately it seems that the criminal wins the day and the victim is always the looser.
It all leads to Government rules.
They say in a case like this "You The victim" have to take private prosecution out toward the offender.
For a back screen I suspect the costs will overcome the price of the screen !
( BTW to be brought to Court at your cost ) Even though you are the victim...
You may well win your case but I will be surprised that the cost of a screen will be worth the effort.....having to take time away from work......travelling costs to and from the solicitors and courts....
And not to mention all the hassle....
Yes the system is compiled so that it is not worth your while !!!!
BUT PLEASE fight it if you can and do not let these sh^t heads off with the crimes they commit.


Been realistic about this situation wouldn't you think the justice system would automatically make sure that you would get a screen fitted and at the cost of the person who committed the criminal act ?

Where has the act of criminal damage towards your property gone ?
And no matter what the overall cost of the material property is ....IT IS still a crime to intentionally damage another persons property....and if you do so you will be prosecuted.


THE SYSTEM IS CRAP....

i once heard or read somwhere that for every association or organisation that helps the victim.
theres 7 organisations to help the criminal.

Rang my insurance up this morning and ive had to pay £75 excess , the window has to be ordered and will only arrive tomorrow afternoon , the total cost for the window and fitting is £375.53. Ive rang my licencing office up and ive had to surrender my plates until the windows been fixed and checked by them. When I looked again this morning ive noticed that the paintwork on my car is also scratched under the window from the shattered glass.

So to sum it up im £75 out of pocket for the window , 2 days loss of earnings £160 ( rough estimate ) and I have damaged paintwork on my car £???

Ill see what the police say over the next few days then Ill have to get myself a good solicitor to try and get my costs back.

Would there be anyway of me finding out the lads name and address or will this be held from me.

MILLY,you could say that you are going to file a complaint in the county court for damages ,might cost you about £20 the police will have to give you the name of the offender in order for you to file. i think that there is a limit of damages awarded of about £500 ,again check with C.A.B..

You are not an idiot mate you just forgot but not being in the union can be costly. Clearly we couldn't represent you because if we did then there are types out there who would take advantage and not join up until there was a problem. This wouldn't be fair on those who have always been members who might need the services of an officer who is spending his time dealing with the users.

However we are not as bad as some on here would have you believe and no doubt Terry or myself or others in the union would at least give some informal advice even on an incident like this that predates membership.

Glad your joining up though and hope to see you at one or two union events in the future like a branch meeting or the big Parliamentary launch meeting that is currently being organised with the General Secretary speaking on the issue of driver safety and the campaign for subsidies so as everyone can have cctv’s fitted in their cabs


Good Luck and it is great to see more women drivers getting involved perhaps it will raise the level of debate on here
